1. Acceptance of Terms
By accessing or using GoodKeen ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.
2. Description of Service
GoodKeen provides online booking and business-management software for tour and activity operators. The Service includes features for managing bookings, taking payments, issuing gift cards, collecting waivers, and communicating with customers.
3. Account Registration
To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
4. Plans and Payment
GoodKeen offers a free plan and paid subscription plans. Paid plans are billed in advance on a monthly basis. GoodKeen does not charge per-booking or transaction fees on any plan. Card processing fees charged by your payment provider (Stripe) are separate and are payable by you to that provider.
Paid plans have no lock-in — you may cancel at any time from your account settings and will move to the free plan at the end of your current billing period. Subscription fees already paid are non-refundable except as required by law. See our Refund & Cancellation Policy for details. We may change pricing with 30 days' notice.
5. Bookings, Cancellations and Refunds
GoodKeen provides the tools you use to sell and manage bookings, but each operator sets and is responsible for their own cancellation and refund terms with their guests. When you issue a refund to a guest through the Service, it is processed to the original payment method via your payment provider. Refunds between operators and guests are a matter between those parties. See our Refund & Cancellation Policy.
6. Gift Cards
Operators may sell gift cards through the Service. Gift cards issued through GoodKeen are valid for a minimum of 3 years from the date of purchase, consistent with New Zealand consumer law, and their balances do not expire before then. The operator who sells a gift card is its issuer and is responsible for honouring it. Gift cards are redeemable for bookings and are not exchangeable for cash except where required by law.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorised access to the Service
- Interfere with or disrupt the Service
- Transmit any malicious code or content
- Resell or redistribute the Service without authorisation
8. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. You retain ownership of your data and grant us a licence to use it solely to provide the Service. You are responsible for handling your guests' personal information in accordance with the New Zealand Privacy Act 2020.
9. Intellectual Property
The Service and its original content, features, and functionality are owned by GoodKeen and are protected by copyright, trademark, and other intellectual property laws.
10. Termination
We may terminate or suspend your account at any time for violation of these terms. You may cancel your account at any time through your account settings. Upon termination, your right to use the Service will immediately cease.
11. Limitation of Liability
To the maximum extent permitted by law, GoodKeen shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Nothing in these terms limits rights you may have under the Consumer Guarantees Act 1993 or other New Zealand law that cannot be excluded.
12. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through the Service. Continued use after changes constitutes acceptance of the new terms.
13. Governing Law
These terms are governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions.
